Refund Policy
All sales are final. No refunds will be provided. Your registration is non-transferrable and not eligible for resale. Player substitutions will be admitted according to the official rules written for each event at the time of registration. Credits will be provided, at the discretion and subject to terms to be determined by World Golf Skills, for future America’s Golf Festival events if the situation arises that an America’s Golf Festival event (or any postponed, substitute or replacement event) is for any reason postponed or cancelled.
Damages Policy
By registering or participating in this event, I understand that I am fully responsible for any damages that may arise to third parties and to property. This includes (but is not limited to) any damages to persons, golf course property, golf carts, or any additional damages. Without limiting the generality of the foregoing, I agree to indemnify and hold World Golf Skills, its officers, directors, employees, facility operators, partners agents, contractors, affiliates and sponsors harmless for any and all injuries sustained by myself or any third party or parties as a result of my participation and understand that I accept full liability for any damages or injuries that may arise out of my participation for the events in which I am registering.
Golf Course Policy
I agree to protect, indemnify, defend and hold harmless World Golf Skills, the Las Vegas Paiute Golf Resort, Bali Hai Golf Club, Cili and any of their officers, directors, employees, facility operators, partners agents, contractors, affiliates and sponsors against all claims, losses or damage to persons or property arising out of or connected with any America’s Golf Festival events. This includes any damages or injuries that result from the usage of any golf carts and facilities. World Golf Skills, the Las Vegas Paiute Golf Resort, Bali Hai Golf Club, and Cili are not responsible for the loss of or damage to any property that is brought to the facility by hosts or attendees before, during or after the event. World Golf Skills, the Las Vegas Paiute Golf Resort, Bali Hai Golf Club, and Cili are not responsible for any shipment charges of items left behind by hosts or attendees.
Club Storage Policy
If at any point I elect to store my golf clubs at a golf facility, I understand that I am fully responsible for any losses or damages that may arise to the property that is being stored and that World Golf Skills and the associated golf facility are not liable for any losses or damages that may occur while my property is in their possession.
Consent and Release
I understand and agree with all of the associated rules, policies, and eligibility requirements for America’s Golf Festival as found online at www.americasgolffestival.com and may be changed from time to time, without prior notice. I further understand and agree that all decisions of World Golf Skills, LLC, a North Dakota limited liability company (“World Golf Skills”), its agents and employees with regard to America’s Golf Festival, including eligibility, qualifying, participation, scoring, handicapping, play, standing, prizes, postponement, and cancellation of events are final.
I acknowledge that my participation in America’s Golf Festival and related events may result in illness, injury or death, whether to myself or a third party or parties. To the fullest extent permitted by law, I agree to indemnify, release and hold harmless each of World Golf Skills, its officers, directors, employees, agents, contractors, affiliates and sponsors for any and all illness, injury or death sustained by myself or any third party or parties as a result of my participation. I understand that my participation in the America’s Golf Festival and any of its events is at my own risk.
I hereby grant World Golf Skills its affiliates and assigns consent to use my name, likeness, quotes, photos, video and still images and recordings of my voice and that of my family in connection with America’s Golf Festival (collectively all of the foregoing the “Images”), with or without my name or identifying information and for any lawful purpose, in any format, now known or later developed, including for example such purposes as publicity, illustration, advertising, and/or Web content. I understand that there is no time limit on the validity of any of the consents and releases granted hereunder nor is there any geographic limitation on where these materials may be distributed. Upon any fixing of the Images in any medium, all right and ownership to those materials shall pass to World Golf Skills, and World Golf Skills may copyright, trademark or otherwise protect its rights in such materials in its discretion. I understand that any Image may be edited, copied, exhibited, published and/or distributed, and I waive the right to inspect or approve the Images prior to use. I understand that the Images or any part of them may be modified to be used as design elements. I will not hold World Golf Skills responsible for any use or misuse of the Images. I agree to hold harmless World Golf Skills from any and all actions, claims, and demands arising out of or in connection with the use of all or any part of the Images or editorial or comment which may accompany the Images in their displayed format.
Further, I waive any right to royalties and/or any other type of compensation arising from or related to the use of any Image. I hereby agree to release, defend, and hold harmless World Golf Skills and its agents and/or employees, including any firm publishing and/or distributing the finished product in whole or in part, whether on paper, via electronic media, or on Web sites, from any claim, damages, and/or liability arising from and/or related to the use of the photographs/video, including, but not limited to any misuse, distortion, blurring, alteration, optical illusion, and/or use in composite form, either intentionally or otherwise, that may occur or be produced in taking, processing, reduction, or production of the finished product, its publication, or distribution.
By executing these terms and conditions, I (or my parent/legal guardian if under the age of 18) have read and agree to the official rules listed for each event at www.americasgolffestival.com and associated terms and conditions. Moreover, by executing these terms and conditions, I hereby irrevocably authorize each member of my team (and the parents/legal guardians of any team members under the age of 18) to make as my agent and my team’s agent, any decision (including, without limitation, any decision with regard to any postponement, cancellation, compromise, or refund of fees) with regard to the participation of my team in America’s Golf Festival and any replacement or substitute event, and World Golf Skills is entitled to rely upon such authority.
Authorized consent to these terms and conditions is granted freely, and without obligation. I further understand that I am free to address any specific questions regarding these terms and conditions by submitting those questions to World Golf Skills in writing prior to providing my authorized consent, and I agree that my failure to do so will be interpreted as a free and knowledgeable acceptance of these terms and conditions. I also understand that these terms and conditions are governed by the internal laws of the State of North Dakota.
